Supreme Court rejects Foxwoods' attempts to force zoning permits

HARRISBURG, Nov. 20 – State Rep. Babette Josephs is pleased to report the Pennsylvania Supreme Court today denied Foxwoods Casino's request to force the city of Philadelphia to issue the group its zoning permits. 

 

"I consider this a significant victory in our efforts to ensure positive land use principles where we live, work and raise our families," Josephs said.

 

Without dissent, the court unanimously told the gaming group that it could not circumvent the laws of this Commonwealth and ask its highest court to do the same. While the court ruled it did not have jurisdiction to strike down Philadelphia's zoning ordinance, it did transfer to the Court of Common Pleas Foxwoods' request to mandate the city to issue the permit.

 

"Please know I will continue to fight Foxwoods Casino's request to force the city of Philadelphia to issue its zoning permits," Josephs said.
